Axe Academy LLC Axe Throwing Release of Liability and Waiver Agreement

By signing below, I acknowledge that I fully understand and accept the risks associated with participating in axe throwing activities at Axe Academy LLC. I understand that the use of axes, whether of any size or kind, involves inherent dangers and that I am solely responsible for any injuries or damages that may result from my participation in these activities. I acknowledge and agree to the following:

1. Risks: I understand the inherent risks associated with axe throwing, which includes the potential for serious injury, scarring, loss of important bodily functions, permanent disability, or death. I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.
   
   
2. Voluntary Participation: I am participating in axe throwing activities voluntarily and believe that I am physically, emotionally, and mentally able to participate.
   
   
3. Safety Notification: I will immediately remove myself from participation and notify the nearest staff member if I sense or observe any unusual hazard or unsafe condition, or if I feel that I have experienced any deterioration in my physical, emotional or mental fitness for continued participation.
   
   
4. Assumption of Risk: I assume all the foregoing risks and accept personal responsibility for any damages following such injury, permanent disability, or death.
   
   
5. Release and Waiver: I release, waive, and discharge all actions, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter have for damage or losses on account of injury, including permanent disability and death or damage to property, caused or alleged to be caused in whole or in part by the negligence or other acts of Axe Academy LLC, its subsidiaries, shareholders, directors, officers, employees or agents, as a result of my participation in any axe throwing-related activities. I hereby agree and covenant to save and hold harmless, indemnify, and defend any claim against Axe Academy LLC, its subsidiaries, and its shareholders, directors, officers, employees, or agents, as a result of my participation in any axe throwing-related activities.
   
   
6. No Lawsuit: I agree that neither myself, nor my assignees, heirs, guardians, and/or legal representatives will sue Axe Academy LLC, its subsidiaries, shareholders, directors, officers, employees, or agents as a result of my participation in any axe throwing-related activities.
   
   
7. Care and Responsibility: I agree to always exercise ordinary and reasonable care. I will not be impaired by the use of drugs and/or alcohol on any Axe Academy LLC premises. I acknowledge and agree that Axe Academy LLC shall not be responsible or liable for any accident, injury, theft, loss, or damage caused by my impaired judgment or negligence.
   
   
8. Right to Refuse Entry: I agree and understand that the staff and/or owners of Axe Academy LLC reserve the right to refuse entry, suspend or cancel any axe throwing-related activities at any time for any reason.
   
   
9. By signing this agreement, I hereby grant Axe Academy LLC the right to use my image, likeness, and voice recorded on audio or videotape, without any payment or consideration. I understand and agree that my image may be videotaped, edited, copied, exhibited, published, or distributed, and I waive any right to inspect or approve the finished product where my likeness appears. I also waive any right to receive royalties or compensation arising from the use of my image or recording.
   
   
10. In addition, I agree that I will not use any personal photographs, pictures, videos, or other recorded media taken in, on, or around Axe Academy LLC premises for any unlawful purpose that would infringe upon Axe Academy LLC's proprietary rights. This includes using any recorded media such as photographs, videos, or voice recordings for any personal or professional monetary gain, promotional uses, advertising purposes, or any other type of use that would cause confusion as to the ownership of Axe Academy LLC's business operations. However, I am permitted to take pictures and post them on social media for personal use.
    
    
11. For league play, I understand and agree that all the above waivers, releases, and assumptions of risk will remain on file and apply to the entirety of the current league season, as well as apply whenever I am on any Axe Academy LLC premise.
    
    
12. SEVERABILITY. I understand that the foregoing assumption of risk, release, waiver of liability, and indemnity agreement is intended to be as broad and inclusive as permitted by the law of the state of Washington. If any portion of this agreement is held invalid or unenforceable, it is agreed that the remainder of the agreement shall, notwithstanding, continue in full legal force and effect.
    
    
13. BINDING ARBITRATION. I agree that any dispute relating to or referring to my participation in any axe-throwing-related activities or my presence on any Axe Academy LLC premises shall be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state of Washington, and the decision of the arbitrator(s) shall be final and binding and may be entered in any court of competent jurisdiction.
    
    

ENTIRE AGREEMENT. This release of liability, waiver of claims, expressed assumption of risk, and indemnity agreement contains the entire agreement between the parties and supersedes all prior negotiations, understandings, or agreements, whether written or oral, relating to the subject matter of this agreement.
